By the present application, the applicant questions judgment and order passed by learned Judicial Magistrate First Class, Akola in Misc. Criminal Case No.59 of 2011 dated 14.7.2011. During the course of hearing of the application, learned counsel Shri S.A. Mohta for the non-applicants pointed out that against the said order, the present applicant has already carried a revision before learned Sessions Judge-2, Akola vide Criminal Revision No.107 of 2011 and the said revision is already dismissed by the Revisional Court on 1.1.2013. The typed copy of the .....2/-

Advocate Ms Sheetal S. Deshpande h/f learned counsel Shri S.I. Ali for the applicant also admits about the said fact. She further submits that now she wishes to challenge the said judgment and order and also prays for withdrawal of the present application to file an appropriate proceeding before this Court challenging judgment and order passed by learned Magistrate, Akola dated 14.7.2011 in Misc. Criminal Case No.59 of 2011 along with judgment and order passed by the Revisional Court in Criminal Revision No.107 of 2011 dated 1.1.2013.

The present application is disposed of as withdrawn with liberty as prayed for.
