Heard the learned Senior Counsel for the applicant and the learned A.P.P. for the State.

Perused the F.I.R. and the reply filed by the prosecution.

This application has been filed on expressing an apprehension that the offence under Section 67-A of the Information and Technology Act, 2000 is likely to be added against the applicant in the present crime and considering the same to be reasonable, this Court had granted interim anticipatory bail to the applicant. Now the reply of the prosecution shows that no indication is given regarding possibility of addition of the offence punishable under Section 67-A of the Information and Technology Act. The reply appears to be silent on this aspect in the matter. It is also not

aba.663.16 2 stated that the apprehension so expressed by the applicant is baseless.

In these circumstances, I am of the view that this application deserves to be allowed by assuming that the apprehension so expressed by the applicant is not well founded. Hence, the order.

The application is allowed and the interim anticipatory bail granted to the applicant by this Court on 6th October, 2016 is hereby confirmed on the same conditions. The application is disposed of.
