One of the co-accused Bala Shitode, who has been alleged to have used sword in giving blows to the deceased, has been released on regular bail by this Court. The other coaccused, who participated equally in the assault, though their participation was with iron rods and sticks, have also been released on regular bail by this Court. Participation of this applicant has been alleged by stating that he, together with other co-accused, assaulted the deceased by giving him knife blows. While, the accused, who gave blows of sword, sticks and iron rods, have been released on bail, this applicant continued to remain in jail, perhaps, because of the fact that he did not move any application before this Court earlier. The orders granting bail to the co-accused have become final as they have not been challenged.

ba.882.16 2 In these circumstances, I see no reason to discriminate against this applicant. Hence, the order. The application is allowed and it is directed that the applicant be released on bail on his furnishing a P.R. Bond in the sum of Rs.25,000/- together with one solvent surety in the like sum on the following conditions:

i.

The applicant shall regularly attend the court dates fixed by the trial Court in the matter.

ii. He shall co-operate with the trial Court in expeditious disposal of the case.

iii. He shall not tamper with the prosecution witnesses in any manner.
