A request is made by the learned Counsel for the petitioner Mr. R.P. Joshi, on the basis of instructions received, that the petition may be disposed of as withdrawn keeping open all contentions to be decided at the stage of final hearing.

Considering the issue involved, his request is reasonable.

A further request is made that the dispute be expedited, which request is also reasonable.

The petition is disposed of as withdrawn, with liberty to the petitioner to raise all the contentions at the stage of final hearing. The Co-operative Court shall not be influenced by any observation made earlier, while deciding the contentions at the stage of final hearing, since the benefit of evidence shall be available at that stage. 5.

The learned Co-operative Court is requested to accord priority to hearing the dispute and to conclude the hearing within the next nine months.

The fees of the learned appointed Counsel for respondent 2, be quantified and paid in accordance with the Rules.
