DATED : OCTOBER 7, 2019 This is an application for bail. The applicant is arrested in connection with Crime No.201/2019, registered with Police Station, Shegaon, Dist. Buldhana for an offence punishable under Sections 354-D, 504 and 506 of the Indian Penal Code read with Section 12 of the Protection of Children From Sexual Offences Act, 2012.

Heard Mr.Karode learned counsel for applicant and Mr. Jawade, learned A.P.P. for non applicant-State. The application for bail is primarily opposed by learned A.P.P. on the ground that investigation is in progress and charge-sheet is yet to be filed.

FIR is lodged by victim herself. Report would reveal that she is aged about 17 years and present applicant resides in her neighbourhood and according to the FIR, he used follow her by saying that he loves her. It is also stated in FIR that present applicant has posted her photograph on his WhatsApp profile. It is the only allegation against present applicant.

The applicant is arrested on 14.09.2019. In view

ba889.19.odt the nature of accusation made in FIR and that no objectionable photographs of victim were posted by applicant, in my view, applicant, who is also aged about 20 years, need not continue to be in jail. Hence, I pass the following order.

ORDER

(i) The application is allowed.

(ii) Applicant-Atul s/o Mahadev Sonone be released on bail in connection with Crime No.201/2019, registered with Police Station, Shegaon, Dist. Buldhana for an offence punishable under Sections 354-D, 504 and 506 of the Indian Penal Code read with Section 12 of the Protection of Children From Sexual Offences Act, 2012, on he executing P.R. Bond in the sum of Rs.10,000/- with one solvent surety in the like amount.

(iii) Applicant shall attend Police Station, Shegaon, twice in a week i.e. on every Thursday and Friday and shall be with the investigating officer from 11:00 a.m. to 05:00 p.m. till filing of the charge-sheet.

(iv) After filing of the charge-sheet, applicant shall attend Police Station, Shegaon once in a month i.e. on the last Sunday of every month, till culmination of the trial. (v) Applicant shall not extend any type of threat to the victim and the witnesses.
