The applicant is seeking pre-arrest bail under Section 438 of the Code of Criminal Procedure in Crime No. 286 of 2022 registered with Police Station Parseoni, Dist. Nagpur for the offence punishable under Section 406 of Indian Penal Code.

The allegations in the First Information Report are that there is criminal breach of trust by transferring the amount of Rs.3,000/- and Rs.5,000/- on two occasions from the account of mother and father of the informant to the account of applicant. SKNair

Today, learned counsel for the applicant makes a statement that to show his bonafide the applicant is ready to deposit Rs.8,000/- in this Court. 4.

Thus, considering the allegations and the statement of the applicant that he is ready to deposit Rs.8000/- before this Court to show his bonafide, I am of the opinion that since the relevant documents and record have already been seized by the police, the custodial interrogation of the applicant is not necessary. Accordingly, I pass the following order.

Criminal application is allowed;

ii.

Order dated 10th November, 2022 granting ad-interim anticipatory bail is hereby confirmed with modification that the applicant shall attend the concerned Police Station from 19th December, 2022 till 23rd December, 2022 between 10 am and 12 noon and thereafter as and when his presence is required. iii.
