The present application is for bail filed under Section 439 of the Code of Criminal Procedure, 1973. 2.

After hearing learned counsel for the applicant to some extent and after going through the investigation papers, it appears that 12 years small girl is subjected for sexual assault by the present applicant. The allegation is also supported by the medical certificate and therefore, I have shown my disinclination to grant bail.

The learned counsel for the applicant seeks permission to withdraw the present application with liberty to file an application after one year, if there is no substantial progress in the trial.

Fees of the learned counsel for the non-applicant No.2/Victim, be quantified as per the Rules.

The criminal application is disposed of as withdrawn.
