Heard both the learned counsel for the respective parties.

The learned counsel appearing for the applicant has filed this Miscellaneous Civil Application to transfer the proceeding, which is pending before the Civil Judge Junior Division, Umred, filed by the non-applicant for restitution of conjugal rights.

The learned counsel for applicant has stated that the applicant is staying at Nagpur and she has filed the proceeding under the Domestic Violence Act, 2005 and under Section 498-A of the Indian Prity
2 / 2 60.MCA (Tr) No. 893-2024 Penal Code. The non-applicant is appearing in both the matters. She is living in Nagpur, therefore, it is difficult for applicant to attend the Court of Civil Judge Junior Division, Umred, as there is nobody to escort her. Hence, she prayed to transfer the matter from Civil Judge Junior Division, Umred to Family Court, Nagpur.

The learned counsel for non-applicant have no objection, if the matter, which is pending before the Civil Judge Junior Division, Umred Court, is transferred to Family Court, Nagpur. As the nonapplicant has no objection and already two proceedings are pending before the Judicial Magistrate First Class at Nagpur.

Hence, the Miscellaneous Civil Application is allowed. The Petition bearing No.37 of 2024 pending before the Civil Judge Junior Division, Umred is transferred to the file of Family Court, Nagpur.

Miscellaneous Civil Application stands disposed of.
