Shri R.N.Sen, learned counsel for the respondents prays that the respondents be permitted to withdraw notice that was served on the petitioner to produce documents at Exhibit U25 before the trial Court. He submits that liberty may be granted to move a fresh notice with similar request.

Shri M.G.Bhangde, learned Senior Advocate for the petitioner referred to the decision in 20th Century Fox Corporation (India) (Private) Ltd. Vs. F.H.Lala and ors. 1976 (2) LLN 146. The respondents are permitted to withdraw the notice at Exhibit U-25 with liberty to move a fresh notice to produce such documents. All points raised by both parties are kept open.

In view of withdrawal of notice at Exhibit U-25, the impugned order does not survive. Consequently, the writ petition also does not survive. Accordingly the writ petition is disposed of. No costs.
