23rd November, 2017 The applicant seeks his release on bail pursuant to arrest in connection with Crime No.198/2016 registered at Khamgaon [Rural] Police Station, Distt. Buldana, for the offences punishable under Sections 406 and 420 of Indian Penal Code.

Perused the First Information Report as well as reply filed on behalf of the State.

It is submitted by learned Addl. Public Prosecutor that the trial has commenced and five witnesses have already been examined. The proceedings are now fixed on 27th November, 2017 and within a short period, the prosecution would close its side. It is further submitted that the applicant does not have a permanent place of residence and if he is released at this stage, there is

likelihood of his not co-operating in completion of trial. Considering aforesaid facts, the interest of justice can be served by expediting the proceedings in Regular Criminal Case [RCC] No. 381 of 2016. Accordingly, the trial Court is directed to complete the proceedings expeditiously and preferably within a period of two months from today.

Application is disposed of.

Fees payable to learned Adv. [appointed] for the applicant are quantified at Rs.1500-00 [rupees one thousand five hundred only].
