The petitioner/original plaintiff of Special Civil Suit No.880/2016, has challenged in-action of the trial Court in deciding his application for early hearing of appeal and some applications filed therein.

The partition decree was came to be passed. It was challenged by respondent No.1, in Regular Civil Appeal No.153/2022. In said appeal, the petitioner filed an application dated 02.09.2022, seeking grant of early hearing of appeal and early disposal of applications Exhibit 5, 17 & 18 therein. Prity

In view of above, the trial Court is directed to decide the application for early hearing at the earliest.
