This is an application filed under Section 438 of the Code of Criminal Procedure seeking pre-arrest bail apprehending arrest in Crime No. 146 of 2015 for the offence registered by the non-applicant under Section 420 r/w. 34 of the Indian Penal Code. This Court granted ad-interim prearrest bail by the order dated 29th October, 2015. The matter was listed under objection on 2nd December, 2015 on which date the Court granted one week's time to remove the office objections. As the office objections were not removed the matter was again listed under objection on 11th December, 2015 and this Court passed an order that if the office objections are not removed within one week the interim order shall stand vacated.

The office objections were still not removed and the matter was listed under objection on 22nd December, 2015 on which date this Court grated six weeks' time to remove the office objections. Again the matter was listed on 2nd February, 2016 on which date this Court recorded that the interim order dated 29th October, 2015 stands vacated for non-compliance of the earlier orders. None appeared for the applicant on 9th February, 2016. Today, again the applicant is not represented when the matter is called out.

2 aba564.15 Shri H.R. Dhumale, learned A.P.P. has submitted that the facts on record show that the applicant is not interested in prosecuting the matter.

The submission made by the learned A.P.P. is required to be accepted.

The application is dismissed for want of prosecution.
