Heard Shri V.K. Paliwal, learned Counsel for respondent nos.1 and 2. None for the appellant. Shri A.D. Sonak, learned Assistant Government Pleader is present for respondent no.3.

This Court vide judgment and order dated 13/07/2017 dismissed First Appeal No.182/2006 against the judgment and award passed by the Reference Court. During pendency of appeal, amount of Rs.2,60,054/- came to be deposited vide pursis dated 20/04/2009. Learned Counsel for the respondent nos.1 & 2 states that no appeal has been preferred against the order of dismissal.

caf.3870.17 2 In the above background, respondent nos.1 & 2 are allowed to withdraw the amount along with interest accrued thereon in terms of judgments and orders dated 18/11/2005 passed in Land Acquisition Case No.2/2000 and in First Appeal No.182/2006, dated 13/07/2017 on furnishing usual undertaking within a period of four weeks.

Civil application stands disposed of.
