The trial Court has, vide impugned order, permitted respondent - defendant to examine witness in terms of Order XVI of the Code of Civil Procedure, 1908 on finding that the witness appears to be a material witness, who shall throw light on the issue involved.

To my mind, the trial Court has exercised the jurisdiction in accordance with law. No interference is called for. The petition is accordingly dismissed. (Anil L. Pansare, J.) wasnik
