DATE : October 03, 2017 The applicant apprehends his arrest for offence punishable under Sections 429, 279, 109 read with 34 of Indian Penal Code and Section 5 of the Maharashtra Animal Preservation Act, 1995 pursuant to Crime No.603/2017. According to the applicant, he was merely transporting the cattle for sale and not for the purpose of slaughter. It is submitted that no offence under Section 5 of the Maharashtra Animal Preservation Act, 1995 has been made out against the applicant.

Perused the First Information Report as well as the reply filed. Considering the nature of allegations and the fact that the investigation is at the initial stage, I am not inclined to exercise discretion in favour of the applicant.
