1] Heard learned counsel for the applicant to some extent and after going through the investigating papers, it reveals that the entire case is listed on the circumstantial evidence.

2] After going through the various statement, it reveals that there are some circumstances which goes against the present applicant, DNA report is yet to be received.

3] In view of that, learned counsel for the applicant seeks permission to withdraw the present application as I have shown my disinclination to grant bail and seeks liberty to file fresh, if there is no progress in the trial within one year.
