The applicant is seeking bail in Crime No.179 of 2022, registered with Police Station: Akot (Rural), District: Akola, for the offences punishable under Sections 326, 307, 324 and 504 of the Indian Penal Code. 3.
The prosecution story is that on 24.04.2022 at about 8.30 p.m. the father of the informant went to his agricultural field and at about 10.00 p.m. one Bhaurao Maharankar made a phone call to the informant and told him that the present applicant has inflicted a blow on the neck of the father of the informant by means of sickle. On reaching the field, the informant found his father injured condition.
4.
In this case, the investigation is completed and the charge-sheet has been filed. As per the injury report there are three incised injuries, one is grievance and two are simple. The grievous injury is an incised cut throat wound with bleeding. The injured was hospitalized for ten days. 5.
In the above referred backdrop, considering the period of incarceration of the applicant who is in jail since 25.04.2022, I am of the opinion that further custody of the applicant is not necessary.
6.
Moreover, considering the fact that there is no possibility that if the applicant is released on bail, he will not be available for trial. In the circumstances, by putting certain stringent conditions the applicant shall be released on bail. Accordingly, I pass the following order: a) The criminal application is allowed.
b) It is directed that the applicant shall be released on bail in Crime No.179 of 2022, registered with Police Station: Akot (Rural), District: Akola, for the offences punishable under Sections 326, 307, 324 and 504 of the Indian Penal Code, on furnishing P.R.
