Heard learned counsel for the rival parties. Perused the reply filed on behalf of the respondentState. The applicant was arrested on 3.10.2015 in respect of Crime No. 270/2015 for offence punishable under Sections 354, 354A, 452 of the IPC and u/s 3 (1)(xi) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocity) Act, 1989, registered at Police Station, Pandharkawada, Dist. Yavatmal. It is reported that, by this time, the investigation must have been completed. Moreover, the applicant undertakes to reside at place other than the place of residence of the prosecutrix victim/witnesses. In that view of the matter, I make the following order:
ORDER
I) Criminal Application (BA) No. 833/2015 is allowed.
ii) The applicant-Mahesh Shankar Karpe be released on bail in respect of Crime No.270/2015,
30.11.ba.833.15 upon his furnishing personal bond in the sum of Rupees ten thousand (Rs.10,000/-) with one surety in the like amount.
(iii) The applicant shall not enter the village boundary of Pimpli Road, Tq. Kelapur Dist. Yavatmal until the trial is over.
(iv) The Police Station Officer Pandharakwada shall inform the complainant, Police Patil and Sarpanch of the village that the applicant cannot enter village Pimpli Road, Tq. Kelapur, till the trial is over. (v) The applicant shall not tamper with the prosecution evidence.
