In this petition, the petitioner claimed to direct the respondent - Caste Scrutiny Committee to decide the caste claim which is pending before respondent No.1 - District Caste Scrutiny Committee, Yavatmal.

Learned Counsel for the petitioner further submits that first Cap Round is over; however, second Cap Round may commence within 7 to 8 days. As the Caste Scrutiny Committee failed to decide the petitioner's claim he could not participate in the first Cap round.

Otherwise, vide Government Resolution dated 26/08/2025 the State Government has granted six months time to submit the Validity Certificate for those who are admitted in Engineering, Medical and other professional courses to the categories of SBC and OBC. In view thereof, if such permission is

granted to the petitioner to participate, no prejudice is going to be caused to any of the parties provided specific directions to the Caste Scrutiny Committee would be given to decide the claim within a period of three weeks.

We are of the considered opinion that the directions to the Caste Scrutiny Committee are required to be issued to decide the caste claim on the basis of Vigilance Report, wherein two documents were collected by the Vigilance Cell pertaining to the Father of the petitioner and Grandfather of the petitioner dated 06/12/1973 and 27/03/1951 respectively. These documents were duly verified by the Vigilance Cell, and therefore, there is no reason to return the claim and direct the petitioner to place on record the documents prior to cut-off date. 6.

Accordingly, we direct the Caste Scrutiny Committee, Yavatmal to decide the claim on the basis of the Vigilance Cell report and on the basis of affidavits and documents submitted by the petitioner, within a period of three weeks. Respondent Nos.2 and 3 are further directed to allow the petitioner to participate in second Cap Round as prayed for. 7.

The petitioner shall appear before the Caste Scrutiny Committee, Yavatmal on 08/09/2025.

The petitioner is permitted to place on record any additional evidence if available, before the Caste Scrutiny Committee.

The petition stands disposed of.

Learned AGP shall communicate this order to the Caste Scrutiny Committee, Yavatmal.

Copy of this order be furnished to the parties to act upon.
