Heard the learned counsel for the rival parties. The learned counsel for respondent no.2 states that respondent no.2 does not want to compound the offence registered against the applicant.
The learned counsel for the applicant submits that there is no case made out against the applicant in the charge-sheet filed against the applicant and, therefore, this Court should interfere and quash the charge-sheet.
Upon perusal of the documents placed on record mainly the FIR and the charge-sheet, we think that the applicant should be relegated the alternate remedy. Hence, we make the following order:- Order Criminal Application (APL) no.687/2014 is disposed of reserving the liberty in favour of the applicant to apply for discharge or to take such other appropriate steps as available in law. Criminal Application for discharge is filed before the competent Court and the same shall be decided expeditiously. JUDGE JUDGE AMBULKAR
