The applicant is arrested in crime registered against him by the non-applicant for the offences punishable under Sections 302 and 201 read with Section 34 of the Indian Penal Code, on the allegation that the body of deceased Ganesh was found in burnt condition and nylon rope and diesel Can alleged to have been used in the alleged crime are discovered at the instance of Nitin (co-accused). The applicant is implicated in view of the circumstantial evidence against him.

The applicant is in custody since 11-02-2015. 4.

The applicant has stated that he has not been involved in any other crime earlier. The charge-sheet is filed. The non-applicant has not been able to show that

2 ba835.15 custody of the applicant is required for further investigation.

In view of the above, I am satisfied that the applicant is required to be released on bail. 6.

Hence, the following order :

i) The applicant having been arrested in Crime No.19/2015 registered by the non-applicant, he be released on bail, on furnishing P.R. Bond in the sum of Rs.25,000/- and two solvent sureties in the like amount.

ii) The applicant shall attend every date of sessions trial unless exemption is granted by the Sessions Court. In case the applicant fails to attend any date without seeking exemption from the Sessions Court, this order shall stand recalled. iii) The application is allowed in the above terms. JUDGE pma
