Coram : S. B. Shukre, J Dated : October 26, 2016 Heard learned counsel for applicant and learned APP for the State.

The applicant is in jail since 12th September, 2016. His custodial interrogation is not required for any longer period of time. Considering the nature of allegations made in the report, I am of the view that he could not be justified. The applicant is in jail for any further period of time specially when his custodial interrogation is not necessary.

The application is, therefore, allowed.

It is directed that the applicant be released on bail on furnishing a PR Bond of Rs.15,000/- together with one solvent surety in the like amount on condition that :

I) That the applicant shall attend the concerned Police Station, as and when required by the police. II) Applicant shall co-operate with the Investigating Officer in the matter of investigation.

2 923.ba.890.16 III) Applicant shall not tamper with the prosecution witnesses, in any manner.

Hamdast granted.

Application stands disposed of accordingly.
