10th October, 2016 The Applicant - Ayyub Kha @ Lala Yunus Kha is present in the Court. He is identified by his Adv. Shri A.K. Bhangde.
In view of affidavit and documents annexed, we find that he was prohibited by sufficient cause from remaining present on 22nd August, 2016 and thereafter on 8th September, 2016.
He undertakes to remain present on each and every date when the matter is called out for final hearing along with his Advocate.
Mr. Bhangde informs that the applicant was on bail during pendency of trial.
In this situation, the applicant shall execute a fresh bail before Trial Court on same terms and conditions, within one week from today and compliance thereof shall be informed to this Court by filing a proper affidavit. In that bail, he shall also undertake to remain present along with his counsel on the dates of hearing of present Criminal Appeal.
It is made clear that this Criminal Appeal under Section 12 of the Maharashtra Control of Organized Crimes Act, 1999 [M.C.O.C. Act] shall be listed for final hearing on 28th November, 2016 and the applicants shall remain present without fail with their counsel on that date. This shall be the condition of bail and undertaking accordingly shall be filed by them as also by their surety.
The application is accordingly partly allowed and disposed of.
