The counsel for petitioner, on instructions, seeks permission to withdraw the petition with liberty to avail remedy as is available under law. The counsel for petitioner further submits that the petitioner is willing to deposit 50% of the fine amount and accordingly, he made a request to release the vehicle upon depositing the said amount.

In my view, the first part of relief can be granted which relates to withdrawal of petition with liberty to avail remedy as is available under law. So far as the relief of release of vehicle is concerned, the request to that effect be made before the appropriate Authority, if the petitioner intends to challenge the order passed by the Sub Divisional Officer. 3.

With the above observation, permission to withdraw the petition with liberty as prayed for is granted. 4.

The petition is disposed of in above terms. Civil Application No.30 of 2025 for amendment of petition is also disposed of as does not survive.
