Though the application is lacking in some necessary details and the advocate for the non-applicant no.1 opposes the application, for the reasons stated in the application and considering the fact that the non-applicant no.1 has not filed any reply to the application, the delay of 139 days in filing the appeal is condoned. The civil application

However, this is on the condition that the applicant shall pay costs of Rs.500/- to the learned advocate for the non-applicant no.1 and produce the receipt showing the payment till 30 th January, 2015. In default on the part of applicant to comply with the above orders, this order shall stand recalled and the civil application and appeal shall stand dismissed without reference to the Court.
