2023:BHC-NAG:15756-DB 24-CP-347-2023.odt 1
IN THE HIGH COURT OF JUDICATURE AT BOMBAY,
NAGPUR BENCH : NAGPUR.
CONTEMPT PETITION NO. 347 OF 2023 IN WRIT PETITION NO.478 of 2023(D) Swati d/o Rambhau Nannaware vs.
Mr. Gajjaannan Funde, Deputy Director and Member Secretary, Scheduled Tribe Certificate Scrutiny Committee, Chandrapur and others.
--------------------------------------------------------------------------------------------------------- Office Notes, Office Memoranda of Court's or Judge's Order Coram, appearances, Court's Orders or directions and Registrar's order --------------------------------------------------------------------------------------------------------- Shri P. P. Dhok, Advocate for petitioner.
CORAM :- A.S.CHANDURKAR AND ABHAY J. MANTRI, JJ. DATE :- 27th OCTOBER, 2023 The learned counsel for the petitioner submitted that despite directions issued in Writ Petition No.478/2023 the claim of the petitioner seeking validity certificate has not been decided on merits. 2.
It is seen that the Scrutiny Committee on 04.08.2023 has considered the petitioner's claim and refused to grant validity certificate on the ground that the caste certificate issued is by an Authority beyond the territorial jurisdiction of the Scrutiny Committee. It is submitted that the order dated 04.08.2023 passed by the Scrutiny Committee has been challenged in Writ Petition No. 6254 of 2023. 3.
We find that only direction issued in Writ Petition No.478/2023 was to decide the petitioner's claim. Since the claim of the petitioner has been decided on 04.08.2023 and that order has been separately challenged by filing writ petition, we do not find any reason to proceed further with the present proceedings.
4.
The contempt petition is disposed of accordingly. All points sought to be raised by the petitioner in the present proceedings are kept open to be raised in the writ petition.
(ABHAY J. MANTRI, J.) (A.S.CHANDURKAR, J.) Andurkar.
