The applicant is arrested in Crime No.543 of 2025 registered with Police Station Frezarpura, district Amravati City for the offence punishable under Section 309(6) of the Bharatiya Nyaya Sanhita, 2023.

It is the case of the prosecution that on 27.06.2025 Sagar Ramsingh Padhe, a home guard and delivery worker in Amravati, was robbed during his route. While delivering a parcel to a customer named Tanmay Borakr, Sagar was lured to a bridge where Tanmay and two other arrived on motorcycles. After handing over the parcel, Tanmay and an accomplice fled when Sagar tried to pursue them, he found the group at an open plot. There, they threatened him with a knife, assault him, and stole his bag

2 / 3 42-ba 1049-25 containing Rs.7,395/- and 12 parcels worth Rs.12,202/-. Sagar reported the incident and the crime is registered, on the complaint lodged.

The learned counsel appearing for the applicant has stated that the applicant is juvenile. He is in remand home since last three months. Juvenile Justice Board and the Sessions Court, have rejected the application. considering his age, prayed to release him on bail.

4. The learned APP opposed the application stating that applicant is habitual offender. Earlier three offences of similar nature are registered, he has used knife. At this stage, it is not proper to release him on bail. Hence, prayed to reject the application.

5. Heard both the sides.

6. The applicant has committed robbery. There are three more cases of robbery. He is of tender age, if he is released on bail, there is every possibility of indulging in the similar nature of offences. It is better for the future of the applicant to keep him in remand home for few more days, as he has committed similar kind of offences and modus operandi is same. He is habitual offender and keeping him in remand home is not the punishment. It is for the
