Heard Ms. S.B. Khobragade, learned counsel for the petitioner and Shri M.J. Khan, learned APP for the respondents.

Perused the reply. We are not inclined to go into the merit of the controversy at this stage.

From the communication placed as Annexure RII with reply affidavit by respondent No. 3 and assertion in that affidavit in paragraph 4, it appears that the respondents have carried out the exercise of categorization and submitted it to the office of the concerned Additional Sessions Judge, Nagpur on 24.12.2014. We find that up to 15.01.2016, about 10 reminders have been sent but no cognizance thereof has been taken.

The present petitioner has been sentenced on 05.09.2003. According to Ms. Khobragade, he will be competing the period of 14 years shortly.

In this situation, we direct the concerned Court to take suitable decision on the said communication or at least on the case of the present petitioner within a period of
1204cwp798.16 four weeks from the date of communication of this order to it.

From the record we find that Annexure R-II dated 15.01.2016 is addressed to the 6th Additional Sessions Judge, Nagpur.

Accordingly, we partly allow the present Criminal Writ Petition and dispose it of. No order as to costs.
