Heard Ms Prajakta Chaudhari, advocate for the applicant and Shri A.K. Bangadkar, A.P.P. for the nonapplicant. The applicant is seeking pre-arrest bail apprehending arrest in the crime registered against him under Section 65(A) (E) and 83 of the Maharashtra Prohibition Act. The accusation against the applicant is that, inspite of ban on sale of liquor in Gadchiroli district, the applicant, along with co-accused brought liquor within the limits of Gadchiroli district. It is alleged that on information that the liquor is being transported in a vehicle, the vehicle is intercepted and two persons who were travelling in the vehicle ran away. On the suspicion that the applicant was one of the persons, crime is registered against him along with other accused. The vehicle is not owned by the applicant. Considering the nature of the allegations, in my view, the applicant is entitled for pre-arrest bail. Hence, the following order :

2 aba572.15 In the event of arrest in Crime No.6214 of 2015 registered by the non-applicant, the applicant shall be released on bail on furnishing P.R. Bond in the sum of Rs.Twenty Thousand.
