The applicant is arrested on 7th September, 2016 in crime registered against him for the offence punishable under Sections 65(e) and 83 of the Maharashtra Prohibition Act and Section 188 of the Indian Penal Codee on the accusations that he is involved in stocking liquor though sale of liquor in Chandrapur district is prohibited.

The investigating agency has opposed the

2 ba895.16 application principally on the ground that the applicant is habitual offender and is involved in various crimes since 2006. The learned A.P.P. has made available copy of order passed by the learned Additional Sessions Judge in Miscellaneous Criminal Application No.581/2016 on 23rd September, 2016 in which it is recorded that C.I.S. report shows that three cases are pending against the applicant.

Considering the facts of the case, I am not inclined to grant the prayer made in the application. The application is dismissed.
