In view of the statement made on affidavit by the investigating officer dated 04.11.2019 that the investigating agency has already filed "A" summary before the learned Magistrate, which is yet to be accepted. We therefore pass the following order:

ORDER

(i) The writ petition stands disposed of.

(ii) It shall be open for the petitioner to approach before the learned Magistrate in whose Court "A" summary is filed, is permitted to file protest petition, if he chooses. If the protest petition is filed, the learned Magistrate is directed to give opportunity of hearing to the petitioner and pass the appropriate order.
