Mrs. Rashi Deshpande, learned A.G.P. for respondent nos. 1 & 3 and Mr. S.G. Jagtap, learned Advocate for respondent no.2 are present and waive notice. The learned Counsel for the applicant/original claimant submits that there is delay of 187 days in filing appeal for enhancement of the amount of compensation in land acquisition matter. The delay is not deliberate. The applicant is poor and resides in remote place from Nagpur. He took time to obtain legal assistance. Hence, delay be condoned. The application is opposed by the learned Counsel for the respondents.
In view of the submissions of the learned Counsel for
18.2CAF.12.15 the appellant and on considering the reasons mentioned in the application, I am satisfied that there is a sufficient cause to condone the delay. Hence, the application is allowed. The First Appeal be registered.
