The present application is filed by the applicant/accused under Section 439 of the Code of Criminal Procedure for grant of bail.

The applicant/accused is arrested in respect of Crime No.533/2020 registered with the Police Station Kalamna, Nagpur for the offence punishable under Sections 302, 120B(1), 143, 144, 147, 148, 504, 201 read with Section 149 of the Indian Penal Code and under Section 4 and 25 of Arms Act, 1959 and Section 135 of Maharashtra Police Act, 1951.

After hearing the learned counsel for the applicant for some time and on perusal of the material collected by the investigating officer during

(2) 50.ba.1295.2022 investigation, it reveals that applicant has assaulted the deceased with the deadly weapon and therefore, Court has expressed that, Court is not inclined to grant bail to the present applicant/accused. Learned counsel for the applicant submitted that he is withdrawing the application with liberty to file fresh bail application in case of change in circumstances, like if the trial is not initiated within six months.
