By the present application, the applicant/respondent No.1 seeks withdrawal of amount of Rs.49,746/- deposited by the appellant in this Court. The amount is towards the enhancement granted by the Reference Court.

The applicant/claimant is permitted to withdraw the said amount upon furnishing an undertaking to the satisfaction of the Reference Court that if the appeal succeeds, the applicant/claimant shall refund the said amount along with interest thereon at the rate of 6% per annum from the date of withdrawal till it is deposited in the Court. The civil application is allowed and disposed of accordingly.

First Appeal No.715/2012 :- Twelve months' time is granted to file private paperbook. JUDGE *sandesh
