Heard learned counsel Shri Bhushan Dafle for the applicant and learned Additional Public Prosecutor Shri R.S. Nayak for the State.

The applicant is arrested on 10.9.2017 in connection with Crime No.493 of 2017 registered with Police Station Chimur, District Chandrapur for the offences punishable under Sections 65(b)(c)(f) and 83 of the Maharashtra Prohibition Act, 1949 and under Section 188 of the Indian Penal Code.

According to the prosecution, on 10.9.2017 Assistant Police Inspector Dinesh Labde lodged a report that he received a secret information that near lake illicit distillation of Moua Liquor is in progress. On the basis of the said, raid was made. That time, two persons were found preparing Moua .....2/-
Liquor by keeping iron drums in hearth. Out of those two persons, one ran away and another was caught on the spot. He is the applicant.

From the spot, various articles were seized. A panchanama is also prepared.

It appears from the tenor of the reply that the entire investigation is over. The applicant is in jail and everything is seized.

In that view of the matter, the applicant can be released on bail by putting some conditions on him. Hence, I pass the following order:
ORDER
i) The criminal application is allowed.
ii) Applicant Sunil s/o Namdeo Borkar be released on bail on his executing a P.R. Bond in the sum of Rs.5,000/- with one solvent surety of the like amount, in connection with Crime No.493 of 2017 registered with Police Station Chimur, District Chandrapur for the offences punishable under Sections 65(b)(c)(f) and 83 of the Maharashtra Prohibition Act, 1949 and under Section 188 of the Indian Penal Code.

iii) The applicant shall attend the police station once in a month, i.e. on last Sunday of every month, till filing of the charge-sheet.
iv) With this, the criminal application is disposed of.
