By this application, the applicant is seeking condonation of delay caused in filing the application for leave to file appeal against judgment and order dated 30.06.2022 passed by the learned Judicial Magistrate First Class, Hinganghat in S.C.C. No.238 of 2014, thereby acquitting the non-applicant under Section 138 of the Negotiable Instruments Act.

Learned counsel for the applicant submits that delay has been caused because of the Diwali vacation. 3.

Nonetheless the delay being trivial and for the reasons set out in the application, the application is allowed. Delay of 77 days caused in filing the application for leave to file appeal against the judgment and order dated 30.06.2022 passed by the learned Judicial Magistrate First Class,
