DATE : October 20, 2016 Advocate Shri R. L. Khapre, the learned counsel appearing for the petitioner seeks time. However, our attention is invited to Civil Application No.1863 of 2016 filed by a Transport Contractor in which leave to intervene in the matter is sought. While seeking leave there are other issues including prayers for quashing and setting aside the communication dated 24/08/2016 and staying letter communication dated 25/08/2016. After hearing Advocate Shri R. L. Khapre for the petitioner, learned senior Advocate Shri K. H. Deshpande for the Intervenor and learned Assistant Government Pleader Shri M. J. Khan for respondent/State, we find that the relief sought in application for intervention is

2/3 beyond its scope. Hence, we allow the civil application only to the extent of prayer clause (i).

The applicant is added as party Respondent No.6. Necessary amendment be carried out within one week from today. Needless to mention that applicant is free to file fresh proceedings if it has got any substantive grievance in the matter.

Civil application No.1863 of 2016 is disposed of. List the PIL for further consideration on 22/11/2016.
