DATED : 25-02-2025 The issue of mutual transfer, is governed by the policy as reflected from communication dated 11.8.2021 (p43) and any other subsequent policy extant as on date of the application. The petitioners have applied to the respondents, for a mutual transfer in terms of that policy. All that is required to be done is for the respondents to take a decision on that application in terms of the policy as extant and applicable as on that date. A mere plea by Mr. Kapgate, learned Counsel for respondent No.1, that there is an intention to reconsider or change the policy, cannot be a ground or reason, not to take a decision on the application filed by the petitioners based upon the policy which at present is in force. we therefore, dispose off the petition by directing the respondents to consider the application dated 7.12.2021 and decide the same in terms of the policy as of now applicable, within a period of two weeks from today.
