Heard Shri V.D. Bastain, learned Counsel for applicant and Mrs. H.N. Prabhu, learned A.P.P. for the State.
By this application, applicant/accused seeks suspension of substantive sentence of imprisonment awarded by learned Additional Sessions Judge, Nagpur vide judgment and order dated 18/08/2017 in Special Child Criminal Case No.2/2016 thereby convicting the applicant of the offences punishable under Section 354(A)(i) of the Indian Penal Code and Section 8 of the Prevention of Children from Sexual Offences Act, 2012.
The maximum sentence awarded by trial Court is three years rigorous imprisonment.
appa.794.17 2 Learned Counsel for applicant submits that applicant was on bail during trial and after conviction, sentence has been suspended by trial Court.
Considering the short term sentence awarded by trial Court and as applicant was on bail throughout, this Court is inclined to allow the application. Accordingly, the following order :
O R D E R
I.
Execution of substantive sentence of imprisonment awarded by trial Court is suspended during pendency of appeal on applicant's furnishing P.R. Bond in the sum of Rs.15,000/- with one solvent surety in the like amount to the satisfaction of the trial Court.
II. Criminal application is allowed and disposed of in above terms.
