2] Heard learned counsel for applicant and learned A.P.P. for State.

3] The applicant is arrested in connection with Crime No.1262/2017, registered with P.S.Ramnagar, Chandrapur, for the offence punishable under Sections 20 and 22 of Narcotic Drugs and Psychotropic Substances Act,1985.

4] Mainly, the opposition for grant of bail by prosecution is that investigation is in progress and chargesheet is yet to be filed. However, learned A.P.P. fairly makes a statement on the basis of police papers made available to him that the entire investigation is almost over and only formalities of filing chargesheet is remained to be done.

5] According to prosecution, the applicant was accosted and apprehended after following the

mandatory provisions of Narcotic Drugs and Psychotropic Substances Act,1985. Of course, said is denied by the applicant. The rival claim will have to be decided at the time of evidence. This, Court is observing in the light of the quantity that was found in possession of the applicant. Admittedly, the applicant was not having found contraband ganja to the extent of commercial quantity. Further, learned A.P.P. submitted to a question put to him by the Court that no other offence is registered against the present applicant and his past is clean. In view of the fact that the seized ganja is not of commercial quantity the applicant can be released on bail by putting certain conditions. Hence, order.

ORDER

I) Application is allowed.

II) Applicant Rameshwar S/o Shriram Gutte be released on bail in Crime No.1262/2017, registered with P.S.Ramnagar, Chandrapur, for the offence punishable under Sections 20 and 22 of Narcotic Drugs and Psychotropic Substances Act,1985 on he executing P.B. of Rs. 15000/- with two solvent sureties in the like amount .

III) The applicants shall attend P.S.Ramnagar, Chandrapur once in a month i.e. last Friday

of each month and shall be with the investigating officer from 2.00 p.m. to 5.00 p.m.till the culmination of the trial.

The application is disposed of.
