The applicant is arrested in connection with Crime No.0626/2025 registered at Police Station, Tahsil, Nagpur for the offences punishable under Sections 25 read with Sections 3 and 5 of the Arms Act, 1959 and Section 135 of the Maharashtra Police Act, 1951.

On secrete information, Crime Branch has initiated search and during search in the house of the applicant at Timki, one Country made Pistol (Deshikatta) with one magazine and two round was found. The applicant was arrested from the spot and taken in custody.

The learned Counsel for the applicant has stated that the applicant has undergone surgery and therefore, some persons came there to meet him. They were having one bag and said pistol. When they came to know that the police are coming there, they ran away and the bag was lying there. In said bag the pistol was found. Accordingly, the crime is registered.

The learned A.P.P. has stated that pistol was found in his personal search. The live magazines were
2 25.ba.1002.25 found. The applicant was having the said weapon with him without any licence, hence prayed to reject the application. 6.
Heard both the learned Counsel for the respective parties.

The applicant was arrested as he was having said weapon without licence. Now, the investigation is complete. The charge-sheet is also filed. The maximum punishment for the offence punishable under Section 25 of the Arms Act is of seven years. Since last two months, the applicant is in custody. As the investigation is completed, further custody of this applicant is not necessary. There is no antecedent against this applicant. Hence the case is made out to protect the applicant by granting bail. Accordingly, I proceed to pass the following order : i] The criminal application is allowed.
ii] The applicant shall be released on bail in connection with Crime No.0626/2025 registered at Police Station, Tahsil, Nagpur for the offences punishable under Sections 25 read with Sections 3 and 5 of the Arms Act, 1959 and Section 135 of the Maharashtra Police Act, 1951, on furnishing P.R. Bond of Rs.25,000/- with one solvent surety in the like amount.
iii] The applicant shall not in any way tamper with the prosecution evidence.
iv] The applicant shall not pressurize or threaten the prosecution witnesses.
3 25.ba.1002.25 v] The applicant shall attend the concerned police station on every Monday between 1:00 p.m. to 2:00 p.m.
vi] The applicant shall co-operate the investigation officer.
The Criminal application is disposed of accordingly.
