The applicant by way of present application is praying for anticipatory bail in Crime No.217 of 2025, registered with Police Station MIDC, Akola for the offences punishable under Sections 420,468 and 471 of the Indian Penal Code.

The complaint is lodged by one Gajanan Kakade, who is working as Drawing Disbursement Officer and Assistant Registrar Working at Krushi Abhiyantriki Va Tantrik Mahavidyalaya, Dr. Punjabrao Deshmukh Krushi Vidyapeeth, Akola alleging that for clearance of the bills, a certain procedure is being adopted. The entries are taken in the inward and outward register and are forwarded to the

2 / 4 16- aba 701-25 concerned department and after verification those are presented for clearance. Vide letter dated 10.11.2023 misappropriation of Rs.3,84,301/- was informed to the Dean, Krushi Abhiyantriki Mahavidyalaya, Akola. It was done by submitting bogus bills along with the proposal dated 17.10.2023. On verification, it was found that those bills were forged bills. The enquiry was conducted and it was revealed that the applicant had cleared those bills by submitting forged and fabricated documents and has committed the misappropriation of Rs.6,01,0116/- and thereby defrauded the institution by submitting forged and false documents. The crime came to be registered on the said complaint.

The learned counsel appearing for the applicant has stated that departmental enquiry is going on and the documents are with the department and the applicant has already deposited Rs.3,52,271/- by Demand Draft. The counsel for the applicant has stated that the amount which was allegedly misappropriated, is already deposited and the allegations are about the amount, which was not distributed. The applicant is ready to abide by all the conditions. Hence, payed to protect him by granting anticipatory bail.

4. Learned APP has has opposed the application and stated that without depositing the amount, the applicant is

3 / 4 16- aba 701-25 not entitled for anticipatory bail. The documents which are required for further enqury are in custody of the applicant and for the said documents, his custodial interrogation is necessary. Hence, prayed to reject the application.

5. Heard both the sides and perused the record.

6. For misappropriation, the departmental enquiry is already going on and the applicant has deposited the amount which was allegedly misappropriated. Other remaining amount is not disbursed. As applicant is ready to abide by all the conditions imposed, and he is also ready to co-operate the police machinery, the custodial interrogation of this applicant is not required Hence the following order:- i] The application is allowed and it is directed that in the event of arrest of the applicant Deepak Pandit Aglawe, in connection with Crime No.217 of 2025, registered with Police Station MIDC, Akola for the offences punishable under Sections 420,468 and 471 of the Indian Penal Code, shall be released on bail on furnishing P.R. Bond in the sum of Rupees Twenty Five Thousand each with one surety in the like amount.

ii] The applicant shall not in any way tamper with the prosecution evidence.

iv] The applicant shall attend the concerned police station on every Monday and Saturday between 7:00 p.m. and 9:00 p.m.

v] The applicant shall co-operate the investigating officer.
