DECEMBER 12, 2024 The application has been filed by the applicant on 3/10/2024 seeking release on bail for a short period of six to eight weeks.
2] The application was listed before the roster Judge on 22/10/2024. The Court noted that earlier bail application was dealt with by me and, therefore, the application was to be listed before me.
3] The applicant did not take any steps to get the application circulated immediately after 22/10/2024. Ultimately, the Registry has of its own listed the matter today.
4] Thus, it is evident that the applicant is not interested in getting orders for temporary release, may be because the purpose itself has been defeated. 5] At this stage, the learned Counsel for the applicant submits that in the intervening period, the applicant was admitted in hospital and that his relatives
1-BA-959-2024 were trying to get documents and, therefore, the matter was not circulated.
6] The above submission indicates that subsequent to filing application, there occurred some medical issues and the relatives were in the process of obtaining documents, which have been not obtained till date.
7] If what has been stated above is correct, the applicant is at liberty to file fresh application, if so advised. The fact, however, remains that the present application was not pursued and as stated above, may be because the purpose has been defeated.
8] With the above observations, the application is rejected.
