The petitioners are aggrieved by deletion of their name from the voters list. They pray that the voters list published on 13.10.2022 be modified and their names be included in the final voters list. 2.
On perusing the documents filed along with the writ petition as well as the documents produced by the respondents, we find that disputed questions are involved in the matter, that cannot be resolved in writ jurisdiction. One of the reasons for the deletion of petitioners' names is that they are not residing at the given addresses. This fact is denied by the petitioners by relying upon the report of the Talathi. Be that as it may; this question cannot be decided in writ jurisdiction. The petitioners are at liberty to have this question decided by invoking appropriate jurisdiction.

However, it is seen that on 03.11.2022, the petitioners have made representation to the Collector seeking inclusion of their names in
WP.7114.22 the voters list. This application is still pending. It is directed that the Collector, Akola shall decide the same by 03.12.2022 by giving an opportunity of hearing to the petitioners. The petitioners or their representatives shall appear before the Collector, Akola on 29.11.2022 at 11.30 am.

Keeping all the questions raised in the petition open,the petition is disposed of.
