The applicant is arrested in Crime No.345/2025 registered at Police Station, Pusad Rural, District Yavatmal for the offences punishable under Sections 74, 75, 351(2), 351(3) of the Bharatiya Nyaya Sanhita, 2023 and Sections 8 and 12 of the Protection of Children from Sexual Offences Act, 2012.

The victim is 16 years and 9 months of the age. It is alleged that, on 03.05.2025 at around 6.00 p.m. when the victim was in her father's shop, the applicant came there and started talking with her. Thereafter, he tried to hug and pressed her chest. He touched her inappropriately. When she shouted, her maternal uncle came there. Thereafter, the report was lodged and, the crime was registered against this applicant.

With the able assistance of the learned Counsel for the applicant, I have gone through the charge-sheet and it appears that the victim has written the love letters to the applicant.

It appears from the record that the applicant and the victim were having love affair. The victim has filed
2 28.ba.1004.25 her objection on affidavit that she has no grievance against the applicant. Due to misunderstanding and under the pressure of the parents, she has lodged the complaint. No such incident took place.

Considering the letters, which are written by the victim to the applicant and the affidavit which is filed by the victim, the case is made out to release the applicant on bail. Accordingly, I proceed to pass the following order : i] The criminal application is allowed.
ii] The applicant shall be released on bail in connection with Crime No.345/2025 registered at Police Station, Pusad Rural, District Yavatmal for the offences punishable under Sections 74, 75, 351(2), 351(3) of the Bharatiya Nyaya Sanhita, 2023 and Sections 8 and 12 of the Protection of Children from Sexual Offences Act, 2012, on furnishing P.R. Bond of Rs.25,000/- with one solvent surety in the like amount.
iii] The applicant shall not in any way tamper with the prosecution evidence.
iv] The applicant shall not pressurize or threaten the prosecution witnesses.
v] The applicant shall attend the concerned police station on every Monday and Saturday between 1:00 p.m. to 2:00 p.m.
