2] Neither the appellants nor the respondents are aware of the date on which the possession of land was taken over by the Collector. Despite such status, the learned Counsels are trying to put forth calculations of the amount of compensation.
3] Thus, without knowing the fundamental facts, the learned Counsel for respondent no.1 has filed the application and the learned Counsel for the appellants is making a statement that the entire amount of compensation has been deposited.
4] Such is the assistance by the learned Counsels which leads to no conclusion but to complicate the issue, which is otherwise simple.
25-CAF-3813-2023 5] Hopefully, the learned Counsels will come well prepared at least on a petty matters like depositing the amount of compensation and the amount which the other side intends to withdraw.
6] The applications which have been filed without basic enquiry, therefore, are dismissed with liberty to file fresh by incorporating the factual details. FIRST APPEAL NO. 403 OF 2023 7] Record and proceedings were called vide order dated 2/5/2023.
8] Registry to file report as to what steps were taken to get the record and ensure that the same is received within seven working days from today. 9] List the matter once private paper-book is filed.
