The State has filed this application for cancellation of bail which was granted on 01.04.2025 in connection with Crime No.236/2024 registered with Police Station Lakadganj, Nagpur for the offence punishable under Sections 147, 148, 307, 385, 452, 506(2), 201 and 212 read with Section 149 of the Indian Penal Code and under Sections 3, 5, 25, 27 of Indian Arms Act and under Section 135 of the Maharashtra Police Act.

While granting the bail, the condition was imposed not to enter into the vicinity of Nagpur except attending the proceeding before the trial Court till the culmination of the trial. As per condition No.5 the applicant shall not induce, threat or promise any witnesses who are acquainted with the facts of the case and as per Kavita

2 / 2 68-appln 90 of 2025 condition No.vi the contravention of any of the condition would lead the cancellation of bail.

The learned APP has pointed out that immediately after releasing on bail, he has committed another crimes viz: Crime No. 0187/2025 under section 308(3), 296, 115(2) and 351(2) of Bharatiya Nyaya Sanhita, registered with Police Station Shantinagar on 01.08.2025 against nonapplicant. Crime No. 0581/2025 under Section 296, 115(2), 351(3) and 3(5) of Bharatiya Nyaya Sanhita, 2023 came to be registered with Police Station Yashodhara Nagar on 01.08.2025 and Crime No. 0562/2025 under section 296, 115(2), 351(3) of Bharatiya Nyaya Sanhita, 2023 came to be registered with Police Station Kapil Nagar on 01.08.2025. Immediately after releasing him on bail, he has committed three crimes. As the non applicant has flouted the bail by entering the area and committed the offence, the bail granted to him is cancelled. The non applicant to surrender before the concerned Police Station immediately.

4. If the non applicant fails to surrender before the concerned Police Station within 24 hours, non bailable warrant be issued against him.
