It is submitted that the parties have settled the dispute out of the Court and they have jointly filed the application for taking the terms of settlement/compromise on record. The respondent Nos.1 to 3 - the original claimants have been verified by their counsel. On enquiry with the original claimants, they admitted the terms of settlement/compromise contained in the application. 3.

The demand draft of Rs.3,38,500/- is handed over to the respondent No.1 by the learned counsel for the appellant.

In view of the above, the civil application is disposed of.

The respondent No.1 - Leelabai Wd/o Nilkanth Rajurkar is permitted to withdraw the entire amount TAMBE

22 CAF-2888-2024 deposited except statutory deposit in this Court by the appellant with accrued interest, if any.

Statutory deposit of Rs.25,000/- be returned to the appellant alongwith accrued interest, if any. 7.

The appeal is disposed of in terms of the settlement of agreement. Accordingly, the award be drawn in terms of the settlement of agreement.
