Heard Shri B.U. Tayade, learned counsel for the petitioner and Mrs. K.R. Deshpande, learned A.G.P. for respondent nos. 1 and 5.

Learned counsel states that petitioner is more in age and also has more experience, therefore, he should have been selected by the respondent nos.1 and 4. He also points out that as the State Government is making recruitment of clerical posts, B.Ed. cannot be treated as a relevant qualification or a higher qualification.

Learned A.G.P. points out that as the recruitment is being sought with the State
Order 0104wp1014.15 Government, petitioner has to approach the Maharashtra Administrative Tribunal under Section 19 of the Administrative Tribunals Act, 1985.

We accept the objection being raised by learned A.G.P. With liberty to petitioner to approach the Maharashtra Administrative Tribunal in accordance with law, we dispose of the Writ Petition. No costs.
