DATED : NOVEMBER 30 , 2021 Applicant Sneha Taiwade filed this application under Section 24 of the Code of Civil Procedure seeking transfer of Hindu Marriage Petition No.66/2019 field by her husband Anand in the Court of learned Civil Judge Senior Division, Yavatmal.

Notices on the application were issued. Shri S.B. Gandhe, learned counsel appears for non-applicanthusband. Today, when this application was taken up for admission, learned counsel for the wife and counsel for the husband, made a solemn statement before the Court that during the pendency of divorce petition filed by husband, the parties had decided to file the joint petition for divorce. Accordingly the joint application for divorce is filed in the Court of learned Civil Judge, Senior Division, Wardha in H.M.P. No.190/2021.

In view of the aforesaid, counsel for the non applicant husband makes a solemn statement on

mca999.19.odt instructions, that husband Anand Taiwade will withdraw H.M.P.No.66/2019 filed by him before Yavatmal Court. His statement is accepted and it is treated as an undertaking given to the Court.

In view of aforesaid undertaking, learned Counsel for wife, Mr. Deshpande submits that applicant be permitted to withdraw the present application. The application is disposed of as withdrawn.

No order as to costs.
